COURT CASE Dossier No: RG19/11178-No Portalis DBX4- W-B7DOQYW
The Court of First Instance, ruling in contradictory proceedings at first instance and having deliberated in accordance with the Law:
1)
Orders the ‘Caisse Primaire d’Assurance Maladie’  (CPAM) de la Haute Garonne to reimburse under professional legislation the pathology declared on 23 August 2018 by Mr. XX, namely an Aerotoxic Syndrome documented by chronic asthenia, neuro-psychological disorders, and an asthmatic bronchial syndrome.
2)
That the CPAM will be responsible for offsetting the sums already received by Mr. XX in respect of his disability pension since April 28, 2020, against the sums due in respect of this occupational disease
3)
Orders the CPAM to pay the sum of 1,500 euros to Mr XX. on the basis of the provisions of Article 700 of the Code of Civil Procedure.
4)
Leaves any costs to be borne by the CPAM.
